1. Acceptance of Terms

By accessing or using HourVibes ("Platform," "we," "us," or "our"), available at hourvibes.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and HourVibes.

2. Description of Service

HourVibes is a marketplace platform that connects users with verified local guides for facilitated, activity-based social experiences. All sessions take place in public venues and are strictly platonic in nature. Examples of activities include, but are not limited to:

  • Coffee outings
  • Hiking and nature walks
  • Beach days
  • Museum and gallery visits
  • City walks and neighborhood exploration
  • Dining and food tours
  • Rooftop and scenic viewings
  • Farmers markets and local events

HourVibes is not a dating service, escort service, or companionship service. Session fees constitute payment for facilitated social experiences and activities — not for a person's time, presence, or companionship.

3. Eligibility

You must be at least 18 years of age to use HourVibes. By using the Platform, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activity that occurs under your account
  • Not share your account with any third party

5. Local Guides

Local Guides are independent contractors, not employees of HourVibes. By registering as a Local Guide, you agree to:

  • Provide accurate profile information including city, activities, and biography
  • Host all sessions in public venues only
  • Maintain strictly platonic conduct during all sessions
  • Complete identity verification as required by the Platform
  • Comply with all applicable laws and regulations

HourVibes reserves the right to remove any Local Guide from the Platform at its sole discretion.

6. Booking and Payments

Session fees are charged at the time of booking confirmation. All payments are processed securely through Stripe. Session fees represent payment for a facilitated activity-based social experience as described in the booking request — not for any person's time, companionship, or presence.

Refunds are issued at the discretion of HourVibes. Cancellations made more than 24 hours before a scheduled session are eligible for a full refund. Cancellations made within 24 hours of a session may be subject to a cancellation fee.

7. Prohibited Uses

You agree not to use HourVibes for any of the following:

  • Soliciting or engaging in sexual services, escort services, or any form of prostitution
  • Requesting or offering romantic or intimate interactions of any kind
  • Arranging meetups in private residences or non-public venues
  • Harassing, threatening, or intimidating any user or Local Guide
  • Misrepresenting your identity or intentions on the Platform
  • Using the Platform for any illegal purpose under applicable law
  • Attempting to circumvent the Platform to arrange off-platform transactions
  • Posting false, misleading, or defamatory reviews or content

Violation of any prohibited use may result in immediate account termination and, where applicable, referral to law enforcement.

8. Public Venue Requirement

All sessions facilitated through HourVibes must take place in public venues. Private residences, hotel rooms, and other non-public locations are strictly prohibited. Both users and Local Guides are responsible for ensuring compliance with this requirement. HourVibes reserves the right to terminate accounts of users who violate this policy.

9. Platonic Interactions Only

All interactions facilitated through HourVibes are strictly platonic. The Platform does not facilitate romantic relationships, dating, sexual encounters, or any form of intimate contact. Any user or Local Guide who engages in or solicits non-platonic conduct will be immediately removed from the Platform.

10. Safety

HourVibes takes user safety seriously. We provide identity verification for Local Guides and require all sessions to take place in public venues. However, HourVibes cannot guarantee the conduct of any user or Local Guide. You agree to:

  • Exercise reasonable personal judgment and caution during all sessions
  • Report any concerning behavior immediately to support@hourvibes.com
  • Contact local law enforcement in the event of an emergency

11. Disclaimers

HourVibes provides the Platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform, including but not limited to the conduct, reliability, or suitability of any Local Guide. Your use of the Platform is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, HourVibes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages resulting from the conduct of any Local Guide or user. HourVibes' total liability to you for any claim shall not exceed the amount paid by you for the session giving rise to the claim.

13. Dispute Resolution and Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court. You waive any right to a jury trial or to participate in a class action lawsuit. This arbitration agreement does not apply to claims for injunctive or other equitable relief.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in California.

15. Modifications to Terms

HourVibes reserves the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Platform. Your continued use of the Platform following such notice constitutes your acceptance of the updated Terms.
